The Oil and Gas Conservation Commission of the State of Colorado (“Commission”) is considering amendments to the Commission Rules of Practice and Procedure, 2 C.C.R. 404-1 (“Rules”). On April 16, 2019, Governor Polis signed SB19-181, which requires the Commission to adopt rules that “adopt an alternative location analysis process and specify criteria used to identify oil and gas locations and facilities proposed to be located near populated areas that will be subject to” the analysis. §34-60-106(11)(c)(I), C.R.S This rulemaking will change the rules and regulations regarding siting and local governance of siting issues.
